1. Acceptance of Terms
By using LeadAct, operated by ELMABROUK DEVELOPMENT, you agree to these Terms of Service. If you do not agree, do not use the platform.
2. Service Description
LeadAct provides a multi-tenant WhatsApp Business messaging platform including: campaign management, contact management, conversation inbox, message templates, and analytics.
3. Account & Subscriptions
- Agency plan: $97/month — includes up to 3 sub-accounts
- WhatsApp plugin: $10/month — activates WhatsApp messaging
- Email plugin: $10/month — activates email channel
- Message balance: prepaid, consumed per message sent
- Payments accepted via bank transfer or approved payment methods
4. WhatsApp Business Platform Compliance
Users must comply with Meta's WhatsApp Business Policy and Commerce Policy. Prohibited uses include: spam, unsolicited messages, selling prohibited products, or any content that violates Meta's policies. Violations may result in account suspension without refund.
5. Wallet & Refunds
- Wallet balance is prepaid and non-refundable once messages are sent
- Unused wallet balance can be refunded within 30 days of account cancellation
- Subscription fees are non-refundable after billing date
6. Service Availability
We target 99.9% uptime. Scheduled maintenance will be notified 24 hours in advance. We are not liable for Meta/WhatsApp API outages beyond our control.
7. Data Ownership
You own your contact data and message content. By using LeadAct, you grant us a license to process this data to deliver the service.
8. Termination
We reserve the right to suspend accounts that violate these terms or Meta's policies. You may cancel your subscription at any time.
9. Limitation of Liability
ELMABROUK DEVELOPMENT is not liable for indirect, incidental, or consequential damages arising from use of LeadAct.
10. Governing Law
These terms are governed by the laws of Tunisia.
